As a condition of access to, and use of, SwapItGreen's Web-based service, all users
are required to abide by the following:
- not to upload, post, e-mail, transmit or otherwise make available any content that
is morally objectionable, unlawful, false, misleading, harmful, threatening, abusive,
harassing, embarrassing, tortious, defamatory, vulgar, obscene, defamatory, libelous,
invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable,
or, in any way, harmful to minors.
- not exploit people in a sexual or violent manner; display nudity, excessive violence,
or content that contains a link to an adult website; solicit personal information
from anyone under age 18; or publicly post information that poses or creates a privacy
or security risk to any person.
- not to solicit passwords or personal identifying information for commercial or unlawful
purposes from others; or include a photograph or video of another person that you
have posted without that person’s consent.
- not to impersonate any person or entity.
- not to falsely state or otherwise misrepresent your identify or affiliation with
a person or entity, including but not limited to the use of a pseudonym, or misrepresenting
your current or previous positions and qualifications.
- not to forge headers or otherwise manipulate identifiers in order to disguise the
origin of any content transmitted through the service.
- not to upload, post, email, transmit or otherwise make available any content that
you do not have a right to make available under any law or under contractual or
fiduciary relationships (such as inside information, proprietary and confidential
information learned or disclosed as part of employment relationships or under nondisclosure
agreements).
- not to upload, post, e-mail, transmit or otherwise make available any Content that
infringes any patent, trademark, service mark, trade secret, copyright, publicity
right or other proprietary rights of any party. For example, not to provide pirated
computer programs or pirated music or links to them.
- not to circumvent manufacturer-installed copy-protect devices.
- not to upload, post, email, transmit or otherwise make available any unsolicited
or unauthorized advertising, promotional materials, "junk mail," "spam," "chain
letters," "pyramid schemes," or any other form of solicitation.
- not to upload, post, email, transmit or otherwise make available any material that
contains software viruses or any other computer code, files or programs designed
to interrupt, destroy or limit the functionality of any computer software or hardware
or telecommunications equipment.
- not to disrupt the normal flow of dialogue, cause a screen to "scroll" faster than
other users of the service are able to type, or otherwise act in a manner that negatively
affects other users' ability to engage in real time exchanges.
- not to post content in fields that are not intended for that content. For example,
not to input an address in a name or title field.
- not to interfere with, create an undue burden on, or disrupt the service or servers
or networks connected to the System, or disobey any requirements, procedures, policies
or regulations of networks connected to the System.
- not to circumvent, modify, attempt to circumvent or modify, or encourage or assist
any other person in circumventing or modifying any security technology that is part
of the System.
- not to access any other website hosted by the System through technology, social
engineering or any other means whatsoever.
- not to use or launch any manual or automated system, including without limitation,
"robots," "spiders," or "offline readers," that accesses the System.
- not to intentionally or unintentionally violate or conspire to violate any applicable
local, state, national or international law, including, but not limited to, regulations
promulgated by the U.S. Securities and Exchange Commission, any rules of any national
or other securities exchange, including, without limitation, the New York Stock
Exchange, the American Stock Exchange or Nasdaq, and any regulations having the
force of law.
- not to upload, post, e-mail, transmit or otherwise make available any content that
furthers or promotes any criminal activity or enterprise or provides instructional
information about illegal activities including, but not limited to making or buying
illegal weapons, violating someone's privacy, or providing or creating computer
viruses.
- not to provide material support or resources (or to conceal or disguise the nature,
location, source, or ownership of material support or resources) to any organization(s)
designated by the United States government as a foreign terrorist organization pursuant
to section 219 of the Immigration and Nationality Act.
- not to post content or items in an inappropriate category or areas on the System.
- not to manipulate the price of any other user’s posted item or interfere with other
users' listings.
- not to transfer Your Account (including feedback) and User ID to another party.
- not to harvest or otherwise collect information about other users of the System,
including email addresses, without their consent.
- not to take any action that imposes or may impose (in our sole discretion) an unreasonable
or disproportionately large load on our infrastructure.
